By accessing or using the Calorie Smart AI website, mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.

Calorie Smart AI provides calorie tracking, nutrition monitoring, and health-related tools, including:

• Voice-intent meal logging
• AI-powered food recognition from photos
• Barcode scanning for packaged foods
• Integration with Apple Health (steps, workouts, sleep, weight)
• Daily health score and macro tracking
• Subscription-based premium features

The Service is provided “as is.” We may modify, suspend, or discontinue any feature at any time without prior notice.

To use certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account
• Be at least 13 years of age (or the minimum age in your jurisdiction) to use the Service

If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

Some features require a paid subscription. By subscribing:

• You authorize charges to your Apple ID or payment method according to the selected plan
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You may manage or cancel subscriptions in your device’s App Store subscription settings
• Refunds are subject to Apple’s refund policy; we do not control refund decisions

Prices may change with notice. Continued use after a price change constitutes acceptance.

Calorie Smart AI is not a substitute for professional medical, nutritional, or health advice. The Service:

• Provides general nutrition and calorie information only
• Should not be used for medical diagnosis, treatment, or dietary prescriptions
• Does not replace consultation with qualified healthcare providers
• May contain estimates; food recognition and calorie data are approximate

Consult your doctor or a registered dietitian before starting any diet, exercise program, or making health-related decisions. If you have a medical condition or eating disorder, seek professional guidance.

By submitting content (e.g., photos, voice input, meal logs) to the Service, you:

• Grant us a limited license to process, store, and display your content to provide the Service
• Confirm you have the right to share such content
• Accept responsibility for the accuracy and legality of your content

You agree not to: violate laws or regulations; share false or misleading information; interfere with the Service or other users; attempt unauthorized access; or use the Service for commercial purposes without our permission.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

All content, features, branding, and functionality of Calorie Smart AI are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

To the maximum extent permitted by law, Calorie Smart AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use or inability to use the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (e.g., disclaimers, limitations of liability) will survive termination.

These terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in California.
